Terms and Conditions

1. Definitions

  • “Organization” means Hoops College Charities, Inc. (DBA Chase Excellence).
  • “Basketball Program” means any programs, products, or services, offered by the Organization.
  • “Participant” means any individual who participates in the Basketball Program.
  • “Liability Waiver” means the document that participants and/or their legal guardian(s) must sign in order to participate in the Basketball Program.

2. Eligibility

The Basketball Program is open to any participant who is interested in playing basketball at an elite level.

3. Use of the Basketball Program

Participants agree to use the Basketball Program in a lawful and proper manner. Participants agree not to:

  • Use the Basketball Program for any illegal or unauthorized purpose.
  • Engage in any activity that is harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable.
  • Impersonate any person or entity.
  • Violate the intellectual property rights of any third party.
  • Interfere with the use of the Basketball Program by any other participant.

4. Liability Waiver

By signing the Liability Waiver, participants agree to release and hold harmless the Organization from any and all liability for any injuries, losses, or damages that they may sustain as a result of participating in the Basketball Program. Participants also agree to indemnify and defend the Organization from any and all claims that may be brought against the Organization as a result of their participation in the Basketball Program.

5. Changes to the Terms and Conditions

The Organization reserves the right to modify these terms and conditions at any time. Participants are responsible for reviewing these terms and conditions periodically to ensure that they are aware of any changes.

6. Termination

The Organization may terminate a participant’s participation in the Basketball Program at any time for any reason.

7. Disclaimer of Warranties

The Basketball Program is provided on an “as is” basis. The Organization makes no representations or warranties of any kind, express or implied, regarding the Basketball Program.

8. Limitation of Liability

In no event shall the Organization be liable to a participant for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with the participant’s participation in the Basketball Program, whether based on warranty, contract, tort, or any other legal theory.

9. Governing Law

These terms and conditions shall be governed by and construed in accordance with the laws of the State of North Carolina.

10. Entire Agreement

These terms and conditions constitute the entire agreement between the participant and the Organization regarding the Basketball Program. These terms and conditions supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written.

11. Severability

If any provision of these terms and conditions is held to be invalid or unenforceable, such provision shall be struck from these terms and conditions and the remaining provisions shall remain in full force and effect.

12. Waiver

No waiver of any provision of these terms and conditions shall be effective unless in writing and signed by both parties.

13. Notices

All notices and other communications hereunder shall be in writing and shall be deemed to have been duly given when delivered in person, upon the first business day following deposit in the United States mail, postage prepaid, certified or registered, return receipt requested, addressed as follows:

If to a participant: The Participant must provide their address in writing prior to participation in the Basketball Program

or to such other address as either party may designate in writing from time to time.

14. Headings

The headings in these terms and conditions are for convenience only and shall not affect their interpretation.

15. Governing Language

These terms and conditions shall be governed by and construed in accordance with the English language.

Liability Waiver

The Participant, hereby agree to release and hold harmless the Organization from any and all liability for any injuries, losses, or damages that I may sustain as a result of participating in the Basketball Program. I also agree to indemnify and defend the Organization from any and all claims that may be brought against the Organization as a result of my participation in the Basketball Program.

I understand that the Basketball Program involves physical activity and that there is a risk of injury. I hereby assume all risks of injury, whether arising from the negligence of the Organization or otherwise.

I have read and understand the terms and conditions of the Basketball Program, and I agree to be bound by them.
